The Cornhill Quarter Elf Trail Prize Competition Terms & Conditions

These Prize Competition Terms and Conditions (‘Terms’), shall govern the relationship between you (‘you’ ‘your’ ‘participant’) and Lincolnshire Co-operative Limited (a registered society with registration number IP00141R) having its registered office at 15-23, Tentercroft Street, Lincoln, Lincolnshire, LN5 7DB (‘we’ ‘us’ ‘our’ ‘Promoter’), in relation to any prize competition organised by us or by any agent expressly authorised by us (‘our prize competitions’).

Please read them carefully, as they affect your rights and obligations in relation to your participation in any of our prize draws.

It incorporates by reference, such other terms and conditions that we may introduce from time to time.

By participating in any of our prize competitions, you accept to be bound by these Terms and all other terms incorporated by reference, in these Terms.

If you do not agree to these Terms, you must not participate in our prize competitions.

We may amend these Terms from time to time. Where any such amendments are made, we will endeavour to provide notice to you. However, the absence of any such notice shall not invalidate the relevant amendments and if you continue to participate in any of our prize competitions after any such amendment(s), it will be deemed as your acceptance of any such amended Terms.

In the event of any conflict or inconsistency between a term incorporated by reference and a term in any of these Terms, these Terms will prevail and apply.

General

1. The Promoter

The promoter is Lincolnshire Co-operative Society

2. The competition

2.1 The title of the competition is THE CORNHILL QUARTER ELF TRAIL PRIZE COMPETITON 2024

2.2 Twelve Christmas elves will be placed around The Cornhill Quarter Lincoln in the leadup to Christmas, between Saturday 7th and Sunday 15th December 2024. Participants of the competition are to list where each of the twelve elves are located, doing so on their competition entry form available for collection at participating businesses, including Lincolnshire Co-op Sincil Street food store. Once complete and the form is handed into Lincolnshire Co-op Sincil Street food store, all valid entries will be entered into a free prize draw, for the chance to win Everyman Cinema tickets. The winners will be chosen at random. The winners will then be contacted to arrange collection for their prize.

3. How to enter

3.1 The competition will run from 00:00 on 07/12/2024 (the "Opening Date") to 23:00 on 15/12/2024 (the "Closing Date") inclusive.

3.2 All competition entries must be received by the Promoter at Lincolnshire Co-op food store, Sincil Street food store, 18-20 Sincil Street, Block A, Lincoln, LN5 7ET no later than 23:00 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.

3.3 To enter the competition:

(a) Participants must hand in a completed competition entry form, which can be found at Lincolnshire Co-op Sincil Street food store, 18-20 Sincil Street, Block A, Lincoln, LN5 7ET or any participating businesses in The Cornhill Quarter Lincoln to Lincolnshire Co-op Sincil Street food store, 18-20 Sincil Street, Block A, Lincoln, LN5 7ET. The Participant is to try and find all twelve elves around The Cornhill Quarter Lincoln, and list where each elf they found is on the entry form.

3.4 The Promoter will not accept:

(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of posting or transmission as proof of receipt of entry to the competition.

3.5 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.7 Please ask the Promoter if necessary for a copy of these competition terms and conditions.

3.8 Valid entries are all entries with fully completed contact details, with correct locations for all twelve elves around The Cornhill Quarter Lincoln. If only one entry submits a correct list of all twelve, that entry becomes the winner of the first prize, 1x Everyman family ticket. If no entry detail all twelve correct locations, then entries with eleven correct answered will enter the prize draw. If no entry form has eleven correct answers, the criteria to pass the threshold will be reduced to ten correct answers and so on until 2 winners are selected.

3.9 All valid competition entries will enter a random prize draw, conducted by a nominated panel of judges. The prize draw of valid entries will then return two winners at random, through a random generator. One prize can be won by one entry. The decision of the panel of judges will be final.

4. Eligibility

4.1 The competition is only open to all residents in the UK of any age, except:

(a) (a) employees of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration, or whose employment is based primarily within the Property department at Lincolnshire Co-operative Limited 15-23, Tentercroft Street, Lincoln, Lincolnshire, LN5 7DB; or

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

4.2 Entrants under 18 must get permission from their parent or guardian before entering. The details of the parent or guardian must be listed on the competition entry form. The parent or guardian agrees to the terms and conditions on behalf of the entrant.

4.3 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.

4.4 The Promoter will not accept competition entries that are:

(a) automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);

(b) completed by third parties or in bulk;

(c) illegible, have been altered, not received by the Promoter (or agent), delayed reconstructed, forged or tampered with;

(d) photocopies and not originals; or

(e) incomplete.

(f) Inappropriate or offensive

4.5 There is a limit of one entry to the competition per person. Entries on behalf of another person will not be accepted . Joint submissions are allowed for siblings under the age of 18.

4.6 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

4.7 Competition entries cannot be returned.

5. The prize

5.1 The prize(s) are:

• 1x Everyman family ticket (comprised of 4 tickets)

• 1x Pair of Everyman tickets (comprised of 2 tickets)

5.2 The prizes are provided by Everyman Cinema Lincoln for the sole purpose of the competition. Everyman Cinema Lincoln is a tenant of Lincolnshire Co-operative Society, within The Cornhill Quarter Lincoln, owned by Lincolnshire Co-operative Society.

5.3 Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value if circumstances beyond the Promoter's control makes it necessary to do so.

5.4 The prize is not negotiable or transferable.

5.5 In order to claim the prize, the winner(s) must pick up the prizes from a representative of the Property team at Lincolnshire Co-op at Society’s support centre, 15-23, Tentercroft Street, Lincoln, Lincolnshire, LN5 7DB. The exact date, time and location of the collection of the prize(s) will be discussed with the winner(s) via phone call and/or email communication. Details on this are detailed in clause 6.2.

5.6 The Promoter also reserves the right to modify, discontinue, (whether temporarily or permanently), this prize draw without prior notice and any liability to any participant.

5.7 Subject to clause 5.5 and except otherwise as agreed by the Promoter (or the third party), the prize as stated, is not negotiable, non-changeable or transferable and there is no cash alternative.

6. Winners

6.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.

6.2 The Promoter will contact the winner personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted. If you do not respond to the Promoter within 14 days of being notified by the Promoter, then the prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.

6.3 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname of the prize winners and, if applicable, a photograph of them collecting their prize on 20/12/2024] (Announcement Date).

6.4 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter by emailing ‘property@lincolnshre.coop’. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

7. Claiming the prize

7.1 If you are the winner of the prize, you will have 14 days to collect your prize from the Promoter. Refer to the details of how to claim in clause 5.5. If you do not claim the prize by this date, your claim will become invalid.

7.2 The prize may not be claimed by a agent on your behalf.

7.3 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available , or has not claimed their prize within 14 days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the prize draw of correct entries at random that were received before the Closing Date.

7.4 The Promoter does not accept any responsibility if you are not able to take up the prize.

8. Limitation of liability

8.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind. If for any reason a technical interruption, fault or site failure occurs when purchasing online, the Promoter does not take any responsibility for incomplete purchases and any incomplete purchases will not be considered valid for entry into the prize draw. The Promoter accepts no responsibility for any purchases which are not completed for any reason.

8.2 Subject to clause 8.1, the aggregate liability of the Promoter (howsoever it arises in these Terms), shall be limited to the prize (and where the prize is not available, its money equivalent) and nothing more.

9. Ownership of competition entries and intellectual property rights

9.1 All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

9.2 By submitting your competition entry and any accompanying material, you agree to:

(a) assign absolutely to the Promoter all your intellectual property rights held in the competition entry with full title guarantee; and

(b) waive absolutely all moral rights,

in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

9.3 You agree that the Promoter may, in their sole discretion, make your entry available on its website https:/www.incolnshire.coop and/or https://www.cornhillquarter.co.uk and in any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You grant the Promoter a non-exclusive, worldwide, irrevocable licence in perpetuity, for the full period of the intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the intellectual property rights in the competition entry and any accompanying materials for such purposes.

10. Data protection and publicity

We will hold your details securely and confidentially in accordance with the UK GDPR and applicable data protection laws. The Promoter will use your details for prize draw activities and marketing purposes on its website and social media platforms. We will delete them when no longer required.

You can ask us for a copy of your details at any time. Please let us know if your details change or if you no longer want us to hold your details.

11. General

11.1 By sending entries, you are deemed to have read, understood and agreed to be bound by these Terms upon entry into the prize draw. The Promoter reserves the right to refuse entry or refuse to award the prize to anyone in breach of these Terms.

11.2 The Promoter reserves the right to discount any inappropriate or offensive entries and to disqualify, from the prize draw. any entrant suspected of fraud or cheating including, without limitation, through the manipulation of codes, multiple computer-generated entries, or otherwise in our opinion fraudulently falsifying data or acting fraudulently or dishonestly

11.3 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

11.4 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.

11.5 These Terms are agreed between you and the Promoter. Apart from you and the Promoter, nobody else can enforce any of these Terms.

11.6 These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
