Cornhill Quarter Student Prize Draw Terms & Conditions

These Prize Draw Terms and Conditions (‘Terms’), shall govern the relationship between you (‘you’ ‘your’ ‘participant’) and Lincolnshire Co-operative Limited (a registered society with registration number IP00141R) having its registered office at 15-23, Tentercroft Street, Lincoln, Lincolnshire, LN5 7DB (‘we’ ‘us’ ‘our’ ‘Promoter’), in relation to any prize draw organised by us or by any agent expressly authorised by us (‘our prize draws’).

Please read them carefully, as they affect your rights and obligations in relation to your participation in any of our prize draws.

It incorporates by reference, such other terms and conditions that we may introduce from time to time.

By participating in any of our prize draws, you accept to be bound by these Terms and all other terms incorporated by reference, in these Terms.

If you do not agree to these Terms, you must not participate in our prize draws.

We may amend these Terms from time to time. Where any such amendments are made, we will endeavour to provide notice to you. However, the absence of any such notice shall not invalidate the relevant amendments and if you continue to participate in any of our prize draws after any such amendment(s), it will be deemed as your acceptance of any such amended Terms.

In the event of any conflict or inconsistency between a term incorporated by reference and a term in any of these Terms, these Terms will prevail and apply.

1. The Prize Draw

1.1 The Promoter is Lincolnshire Co-operative Limited

1.2 The Agent

1.2.1 The Agent is Attract Limited (12292662)

1.2.2 The agent is authorised by the Promoter to manage, facilitate, and execute the Promotion.

1.2.3 The agent will act in accordance with the Terms and follow all guidelines provided by the Promoter.

The agent does not have the authority to modify the Terms unless expressly permitted in writing by the Promoter.

1.3 The title of the prize draw is CORNHILL QUARTER STUDENT PRIZE DRAW.

2. How to enter

2.1 The prize draw will run from 12:00 on 21/10/2024 (the "Opening Date") to 23:59 on 28/10/2024 (the "Closing Date"), both dates inclusive.

2.2 All prize draw entries must be received by the Promoter as set out at clause 3.3, by no later than 30/10/2024 on the Closing Date. All prize draw entries received after the Closing Date are automatically disqualified.

2.3 To enter the prize draw:

(a) Participants must comment what course they study and at Lincoln based institution on the prize draw post on the Cornhill Quarter Facebook page at Facebook.com/cornhillquarter or on The Cornhill Quarter Instagram page at Instagram.com/thecornhillquarter (each an ‘entry’ and all together referred to as ‘entries’) by the Closing Date., All entries after the closing date will be invalid and disqualified.

(b) There will be one winner, selected from all valid Entries.

(c) The Winner will be selected by an independent random draw from all valid Entries received during the prize draw period.

(d) The independent random draw will be decided and selected by the Promoter or by an agent authorised by the Promoter and the decision of the Promoter (or an agent expressly authorised by the Promoter) shall be final.

2.4 The prize draw is free to enter, no purchase is necessary.

2.5 The Promoter will not accept:

(a) responsibility for prize draw entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of posting or transmission of entries as proof of receipt of entry to the prize draw.

2.6 By submitting a prize draw entry, you are agreeing to be bound by these Terms.

2.7 You can ask us for a copy of these Terms.

2.8 The prize draw entry Winner will be decided and selected at random from all of valid entries by the Promoter (or any agent authorised by the Promoter) and the Promoter’s decision (or any agent authorised by the Promoter), shall be final.

3. Prize draw Eligibility

3.1 The prize draw is only open to all Lincoln based students, UK aged 18 years or over (who must be a registered member of www.facebook.com or www.instagram.com), except:

(a) employees of the Promoter or employees its holding or subsidiary companies;

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies or any agent who are associated with the prize draw or its administration (whether directly or indirectly); or

(c) members of the immediate families or households of (a) and (b) above.

3.2 In entering the prize draw, you confirm that you are eligible to do so and eligible to claim the prize you may win, if successful. The Promoter may require you to provide proof that you are eligible to enter the prize draw.

3.3 Internet access is required.

3.4 The Promoter (or the agent) will not accept prize draw entries that are:

(a) automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);

(b) completed by third parties or in bulk;

(c) illegible, not received by the promoter (or the agent), have been altered, delayed, reconstructed, forged or tampered with;

(d) photocopies and not originals; or

(e) incomplete.

(f) inappropriate or offensive entries.

3.5 There shall only be one entry per person. entries on behalf of another person will not be accepted and joint submissions are not allowed.

3.6 The Promoter (or the agent) reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize draw including on suspicion of any fraud or dishonesty.

4. The Prize

4.1 The Prizes available are:

• A selection of teas from Bird and Blend, Lincoln;

• An intergalactic shower gel from Lush, Lincoln;

• A free burrito, chips and salsa from Tortilla, Lincoln;

• A Student essential hamper from Flying Tiger (including highlights, sweets, notebook, daily planner, and an erasable pen).

The winner will receive all prizes listed above.

4.2 Prizes are subject to availability. There is no cash alternative for the prize however, the Promoter (or the agent) reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter's (or the agent’s) control makes it necessary to do.

4.3 The Promoter (or the agent) also reserves the right to modify, discontinue, (whether temporarily or permanently), this prize draw without prior notice and any liability to any participant.

4.4 Subject to clause 4.3 and except otherwise as agreed by the Promoter (or the agent), the prize as stated, is not negotiable, non-changeable or transferable and there is no cash alternative.

5. Prize Draw Winner (‘winner’)

5.1 The decision of the Promoter (or the agent) regarding any aspect of the prize draw shall be final and binding and no correspondence or discussion will be entered into, in this regard.

5.2 The Promoter (or the agent) will contact the winner via a private message on the social media platform used to enter the competition as soon as reasonably practicable after the Announcement Date as provided in clause 5.5.

5.3 The Promoter (or the agent) will not amend any contact information and the Promoter (or the agent) shall not responsible if a winner does not receive notification or delivery of their prize as a result of having provided incorrect/incomplete details when requested following notification from the Promoter (or the agent).

5.4 The Promoter (or the agent) may either publish or make available information that indicates that a valid prize draw took place. To comply with this obligation the Promoter (or the agent) may publish the surname and county of the prize winners and, if applicable, their winning entries in the Facebook post on 29/10/2024 ("Announcement Date").

5.5 How to claim the prize

5.5.1. The winner will be notified via Facebook or Instagram message as soon as reasonably practicable. The winner will collect the prize themselves from Lincolnshire Co-operative Support Centre, 15-23, Tentercroft Street, Lincoln, Lincolnshire, LN5 7DB. The prize will be collected between the hours of 09:00 and 17:00 on a day agreed upon by the Promoter (or the agent) and the Winner.

5.5.2 If you win the prize, you will have 14 days from the Announcement Date to claim the prize as provided in this clause. If you do not claim the prize by this date, your prize will become invalid. You must provide a postal address to claim the prize.

5.5.3 The Promoter (or the agent) will make all reasonable efforts to contact the winner. If a winner cannot be contacted or is not available, or has not claimed their prize within 14 days of the Announcement Date, the prize will be forfeited by that winner and the Promoter (or the agent) reserves the right to offer the prize to the next eligible participant selected from the correct entries that were received before the Closing Date.

5.5.4 The Promoter (or the agent) shall not accept any responsibility if you are not able to claim the prize.

5.5.5 The Promoter (or the agent) will not provide any assistance to the winner(s) in the collection of the prize, including financial renumeration for any transport related fees.

5.5.6 The prize cannot be claimed by a third party on your behalf.

5.5.7 If you do not want your surname and county included on the winner announcement referred to above in clause 5.4, you must notify the promoter a reasonable period of time before the closing date of the prize draw.

6. Limitation of liability

6.1 Insofar as is permitted by law, the Promoter, its employees, agents, consultants or sub-contractors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter.

6.2 Subject to clause 6.1, the aggregate liability of the Promoter (howsoever it arises in these Terms), shall be limited to the prize (and where the prize is not available, its money equivalent) and nothing more.

6.3 The Promoter (or the agent) accepts no responsibility for entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network, any system failures, network errors, website unavailability, hacks on the system, personal computer issues or any other issue out of our reasonable control or server failure of any kind. If for any reason a technical interruption, fault or site failure or any failure whatsoever occurs when submitting an entry, the Promoter shall not take any responsibility for incomplete submission and any incomplete submission of an entry shall not be considered as valid entry, for the prize draw.

7. Ownership of prize draw entries and intellectual property rights

7.1 All prize draw entries and any accompanying material submitted to the Promoter (or the agent) will become the property of the Promoter on receipt and will not be returned at the end of the prize draw.

7.2 By submitting your prize draw entry and any accompanying material, you agree to:

(a) assign absolutely to the Promoter (or the agent) all your intellectual property rights held in the prize draw entry with full title guarantee; and

(b) waive absolutely all moral rights,

in and to your prize draw entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

7.3 You agree that the Promoter (or the agent) may, in their sole discretion, make your entry available on its website and in any other media, whether now known or invented in the future, and in connection with any publicity of the prize draw. You grant the Promoter (or the agent) a non-exclusive, worldwide, irrevocable licence in perpetuity, for the full period of the intellectual property rights in the prize draw entry (and any accompanying materials), to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the intellectual property rights in the prize draw entry (and any accompanying materials) for such purposes.

8. Data protection and publicity

We will hold your details securely and confidentially in accordance with the UK GDPR and applicable data protection laws. The Promoter (or the agent) will use your details for prize draw activities and marketing purposes on its website and social media platforms. We will delete them when no longer required.

You can ask us for a copy of your details at any time. Please let us know if your details change or if you no longer want us to hold your details.

9. General

9.1 By sending entries, you are deemed to have read, understood and agreed to be bound by these Terms upon entry into the prize draw. The Promoter reserves the right to refuse entry or refuse to award the prize to anyone in breach of these Terms.

9.2 The Promoter (or the agent) reserves the right to discount any inappropriate or offensive entries and to disqualify, from the prize draw. any entrant suspected of fraud or cheating including, without limitation, through the manipulation of codes, multiple computer-generated entries, or otherwise in our opinion fraudulently falsifying data or acting fraudulently or dishonestly.

9.3 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter (or the agent) may, at its sole discretion, reserve the right to exclude you from participating in the prize draw.

9.4 The Promoter (or the agent) reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.

9.5 These Terms are agreed between you and the Promoter (and the agent). Apart from you and the Promoter (or the agent), nobody else can enforce any of these Terms.

9.6 These Terms are governed by English law. If any Participants to this prize draw wish to take court proceedings, then they must do this within the courts in the United Kingdom.

10. By participating in this prize draw, Participants accept Facebook, Instagram and/or Meta Platforms inc, terms and conditions although it is acknowledged that this prize draw is not sponsored or endorsed by, nor associated with, Facebook, Instagram or Meta Platforms inc,. Participants release Facebook, Instagram and Meta Platforms inc, from any and all liability arising out of or in connection with their entry or participation in this prize draw.
