Pumpkin Decorating Prize Competition Terms & Conditions

These Prize Competition Terms and Conditions (‘Terms’), shall govern the relationship between you (‘you’ ‘your’ ‘participant’) and Lincolnshire Co-operative Limited (a registered society with registration number IP00141R) having its registered office at 15-23, Tentercroft Street, Lincoln, Lincolnshire, LN5 7DB (‘we’ ‘us’ ‘our’ ‘Promoter’), in relation to any prize competition organised by us or by any agent expressly authorised by us (‘our prize competitions’).

Please read them carefully, as they affect your rights and obligations in relation to your participation in any of our prize competitions.

It incorporates by reference, such other terms and conditions that we may introduce from time to time.

By participating in any of our prize competitions, you accept to be bound by these Terms and all other terms incorporated by reference, in these Terms.

If you do not agree to these Terms, you must not participate in our prize competitions.

We may amend these Terms from time to time. Where any such amendments are made, we will endeavour to provide notice to you. However, the absence of any such notice shall not invalidate the relevant amendments and if you continue to participate in any of our prize competitions after any such amendment(s), it will be deemed as your acceptance of any such amended Terms.

In the event of any conflict or inconsistency between a term incorporated by reference and a term in any of these Terms, these Terms will prevail and apply.

1. The Promoter

The promoter is: Lincolnshire Co-operative Limited (a registered society with registration number IP00141R) 15-23, Tentercroft Street, Lincoln, Lincolnshire, LN5 7DB

2. The competition

2.1 The title of the competition is Pumpkin Decorating Prize Competition.

2.2 The prize competition is being run to award a winner a festive Halloween hamper, a ‘Boo Basket’. Participants are to submit a photograph of their decorated pumpkin as a Facebook comment on the competition announcement post, posted 18/10/2024. Pumpkins can be painted, carved, or decorated however the participant wishes. All valid entries will then be judged by a panel of three judges comprised of employees of the Lincolnshire Co-operative Limited Communications department on 23/10/2024. Each Judge will award each entry a score out of 10, 10 being the highest mark available, meaning a total of 30 possible points for each singular entry. One winner is to be chosen, with the highest score. The chosen winner will then be contacted by a representative of the Lincolnshire Co-operative Society to arrange a day in which the prize can be collected from their local Lincolnshire Co-operative food store.

3. How to enter

3.1 The competition will run from 12:00 on 18/10/2024 (the "Opening Date") to 23:59 on 22/10/2024 (the "Closing Date") inclusive.

3.2 All competition entries must be received by the Promoter by no later than 23:59 on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.

3.3 To enter the competition:

(a) Participants must comment on the prize draw post a photograph of their decorated pumpkin on the prize competition post, posted on 18/10/2024 on the Lincolnshire Co-operative Facebook page at Facebook.com/Lincolnshire_coop

3.4 No purchase necessary and there is no charge to register for use of the website.

3.5 The Promoter will not accept:

(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of posting or transmission as proof of receipt of entry to the competition.

3.6 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.7 A copy of these prize competition terms and conditions can be sent upon request.

3.8 The competition entries will be judged by a panel of three judges comprised of employees of the Lincolnshire Co-operative Limited Marketing and Communications department. Each Judge will award each entry a score out of 10, 10 being the highest mark available, meaning a total of 30 possible points for each singular entry. Judging will take place on 23/10/2024.

3.9 In the event of a tie-break, the judges will be given one vote each, meaning the winner will be the participant with a majority of 2-1 votes. One winner is to be chosen, with the highest score. The decision of the panel of judges will be final.

4. Eligibility

4.1 The competition is only open to all UK residents within a 20 mile radius of a Lincolnshire Co-operative food store aged 18 years or over (who must be a registered member of /www.facebook.com ), except:

(a) employees of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration, or whose employment is based primarily within the Marketing and Communications department at Lincolnshire Co-operative Limited 15-23, Tentercroft Street, Lincoln, Lincolnshire, LN5 7DB; or

(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or

(c) members of the immediate families or households of (a) and (b) above.

4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.

4.3 The Promoter will not accept competition entries that are:

(a) automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);

(b) completed by third parties or in bulk;

(c) illegible, have been altered,not received by the Promoter (or agent), delayed reconstructed, forged or tampered with;

(d) photocopies and not originals; or

(e) incomplete.

(f) Inappropriate or offensive

4.4 There is a limit of one entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the prize competition.

4.6 Competition entries cannot be returned.

5. The prize

5.1 The prize is a festive Halloween hamper (‘Boo Basket’) comprising of:

• 1x Co-op Poison Apple Brownies

• 1x Co-op 4 Halloween Magic Munch Cakes

• 1x Co-op 4 Spooky Sprinkle Doughnuts

• 1x Co-op 2 Trick or Treat Cupcakes

• 1x Co-op Sour Spiders 130g

• 1x Co-op Frightful Fizzy Fangs 130g

• 1x Co-op Halloween Headband

• 1x Co-op Blood Splat Hands Window Clings

• 1x Co-op Pumpkin Carving Kit

• 1x Suction Cup Light Up Spider

• 1x Pumpkin Light Up Wand

• 1x Spooky Character Bottle

One ‘Boo Basket’ is available to be won.

5.2 Prizes are subject to availability. The Promoter reserves the right to substitute the prize with a prize of equal or greater value if circumstances beyond the Promoter's control makes it necessary to do.

5.3 The prize is not negotiable or transferable.

5.4 In order to claim the prize you must follow the steps detailed in clause 7.

5.5 The Promoter also reserves the right to modify, discontinue, (whether temporarily or permanently), this prize compeition without prior notice and any liability to any participant.

5.6 Subject to clause 5.4 and clause 5.5 and except otherwise as agreed by the Promoter (or the third party), the prize as stated, is not negotiable, non-changeable or transferable and there is no cash alternative.

6. Winners

6.1 The decision of the judges is final and no correspondence or discussion will be entered into.

6.2 The Promoter will contact the winner personally as soon as practicable after the Announcement Date in inform them they have won the prize competition, via a private message to the winner’s Facebook account. The Promotor will ask the winner to provide contact information, including full name and address, to arrange the delivery of the prize to the winner’s local Lincolnshire Co-operative food store (method to claim the prize is detailed in clause 7.)

6.3 The Promoter will not amend any contact information once the competition entry has been submitted.

6.4 If you do not respond to the Promoter within 7 days of being notified by the Promoter of winning, then the prize will be forfeited and the Promoter will be entitled to select another winner in accordance with the process described above.

6.5 The Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation the Promoter will publish the surname and county of major prize winner and, if applicable, their winning entry (photograph from valid entry) in a Facebook prize competition announcement post on 25/10/2024 (‘Announcement Date’). Photographs that form submitted valid entries from unsuccessful participants may also be used in the Facebook prize competition announcement post.

6.6 If you object to any or all of your surname, county and winning entry being published or made available, please contact the Promoter (Marketing and Communications team – communications@lincolnshire.coop). In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.

7. Claiming the prize

7.1 If you are the winner of the prize, you will have 14 days from the Announcement Date to claim the prize by personally attending your local Lincolnshire Co-operative food store, communicated with the Promoter is the private correspondence detailed in clause 6.2.

7.2 The prize may not be claimed by a third party on your behalf.

7.3 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available , or has not claimed their prize within 14 days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.

7.4 The Promoter does not accept any responsibility if you are not able to take up the prize.

8. Limitation of liability

8.1 Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter. The Promoter accepts no responsibility for entries not successfully completed due to a technical fault technical malfunction, computer hardware or software failure, satellite, network or server failure of any kind. If for any reason a technical interruption, fault or site failure occurs when purchasing online, the Promoter does not take any responsibility for incomplete purchases and any incomplete purchases will not be considered valid for entry into the prize draw. The Promoter accepts no responsibility for any purchases which are not completed for any reason.

8.2 Subject to clause 8.1, the aggregate liability of the Promoter (howsoever it arises in these Terms), shall be limited to the prize(and where the prize is not available, its money equivalent) and nothing more.

9. Ownership of competition entries and intellectual property rights

9.1 All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

9.2 By submitting your competition entry and any accompanying material, you agree to:

(a) assign absolutely to the Promoter all your intellectual property rights held in the competition entry with full title guarantee; and

(b) waive absolutely all moral rights,

in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

9.3 You agree that the Promoter may, in their sole discretion, make your entry available on its website www.lincolnshire.coop and in any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You grant the Promoter a non-exclusive, worldwide, irrevocable licence in perpetuity, for the full period of the intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the intellectual property rights in the competition entry and any accompanying materials for such purposes.

10. Data protection and publicity

We will hold your details securely and confidentially in accordance with the UK GDPR and applicable data protection laws. The Promoter will use your details for prize draw activities and marketing purposes on its website and social media platforms. We will delete them when no longer required.

You can ask us for a copy of your details at any time. Please let us know if your details change or if you no longer want us to hold your details.

11. General

11.1 By sending entries, you are deemed to have read, understood and agreed to be bound by these Terms upon entry into the prize draw. The Promoter reserves the right to refuse entry or refuse to award the prize to anyone in breach of these Terms.

11.2 The Promoter reserves the right to discount any inappropriate or offensive entries and to disqualify, from the prize draw. any entrant suspected of fraud or cheating including, without limitation, through the manipulation of codes, multiple computer-generated entries, or otherwise in our opinion fraudulently falsifying data or acting fraudulently or dishonestly

11.3 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

11.4 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.

11.5 These Terms are agreed between you and the Promoter. Apart from you and the Promoter, nobody else can enforce any of these Terms.

11.6 These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.

12. By participating in this prize draw, Participants accept Facebook's terms and conditions (depending on their entry route) although it is acknowledged that this prize draw is not sponsored or endorsed by, nor associated with, Facebook. Participants release Facebook and its holding company, Meta Platforms inc, from any and all liability arising out of or in connection with their entry or participation in this prize draw.
