Valentines Day 2025 prize draw terms and conditions

These Prize Draw Terms and Conditions (‘Terms’), shall govern the relationship between you (‘you’ ‘your’ ‘Participant’) and Lincolnshire Co-operative Limited (a registered society with registration number IP00141R) having its registered office at 15-23, Tentercroft Street, Lincoln, Lincolnshire, LN5 7DB (‘we’ ‘us’ ‘our’ ‘Promoter’), in relation to any Prize draw organised by us or by any Agent expressly authorised by us (‘Prize Draw’).

From time to time, we may run promotions in collaboration with other companies, and in such cases, their details will be outlined in these Terms. (‘Agent’).

By participating in our Prize Draw, you accept to be bound by these Terms. If you do not agree to these Terms, you must not participate in our Prize Draw.

We may update these Terms from time to time, so we encourage you to check our website regularly for any changes. Amendments will take effect from the date they are published on our website here. Your continued participation in our Prize Draw after any such amendment will be deemed an acceptance of the amended Terms.

1. The Prize Draw

1.1 The Promoter is Lincolnshire Co-operative Society Ltd

1.2 The title of the Prize Draw is Valentines Day meal deal prize draw

2. How to enter

2.1 The Prize Draw will run from 12:00 on 07/02/2025 (the "Opening Date") to 11:30 on 10/02/2025 (the "Closing Date") both dates inclusive.

2.2 All Prize Draw Entries must be received by the Promoter as set out at clause 3, by no later than 11:30 on the Closing Date. All Prize Draw Entries received after the Closing Date are automatically disqualified.

2.3 To enter the Prize Draw:

(a) Participants must comment on the designated post on the Lincolnshire Co-operative Limited’s Facebook page at Facebook.com/Lincolnshire_coop available at here (each an ‘Entry’ and all together referred to as ‘Entries’) by the Closing Date. Participants are to comment which item they would choose from the valentines day menu on the prize draw Facebook post. All Entries after the closing date shall be deemed invalid and disqualified.

(b) There will be 3 winners, selected from all valid Entries

(c) The Promoter will randomly select the winners from all valid Entries received during the Prize Draw period in accordance with clause 2.8 of these Terms.

2.4 The Prize Draw is free to enter, no purchase is necessary.

2.5 The Promoter will not accept:

(a) responsibility for Prize Draw Entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

(b) proof of posting or transmission of Entries as proof of receipt of Entry to the Prize Draw.

2.6 By submitting an Entry, you are agreeing to be bound by these Terms.

2.7 You can ask us for a copy of these Terms.

2.8 The Prize Draw winner(s) will be decided and selected at random by the Promoter and the Promoter’s decision shall be final.

3. Prize Draw Eligibility

3.1 The Prize Draw is only open to all residents in the UK aged 18 years or over (who must be a registered member of /www.facebook.com), except:

(a) employees of the Promoter or employees its holding or subsidiary companies who are professionally connected with the Prize Draw or its administration or whose employment is based primarily within the Promoter’s Marketing and Communications Department;

(b) employees of Agents or suppliers of the Promoter or its holding or subsidiary companies or any third party who are associated with the Prize Draw or its administration (whether directly or indirectly); or

(c) members of the immediate families or households of (a) and (b) above.

3.2 By entering the Prize Draw, you confirm that you are eligible to do so and eligible to claim the Prize you may win, if successful. The Promoter may require you to provide proof that you are eligible to enter the Prize Draw.

3.3 Internet access is required.

3.4 The Promoter will not accept Prize Draw Entries that are:

(a) automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications);

(b) completed by third parties or in bulk;

(c) illegible, not received by the promoter (or the Agent), have been altered, delayed, reconstructed, forged or tampered with;

(d) photocopies and not originals; or

(e) incomplete.

(f) inappropriate or offensive Entries.

3.5 There shall only be one Entry per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.

3.6 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Prize Draw including on suspicion of any fraud or dishonesty.

4. The Prize

4.1 The Prize is one set of Lincolnshire Co-operative food store vouchers with the value of £15. Three sets of £15 vouchers are available to be won.

4.2 The winners will receive one set of vouchers totalling a value of £15 to be spent within Lincolnshire Co-operative food store outlets each.

4.3 Prizes are subject to availability. There is no cash alternative for the Prize however, the Promoter reserves the right to replace the Prize with an alternative Prize of equal or higher value if circumstances beyond the Promoter's control makes it necessary to do so.

4.4 The Promoter also reserves the right to modify or discontinue (whether temporarily or permanently), the Prize Draw without prior notice and liability to any Participant.

4.5 Subject to clause 4.3 and except otherwise as agreed by the Promoter, the Prize as stated, is not negotiable, non-changeable or transferable and there is no cash alternative.

5. Prize Draw Winners (‘winner’)

5.1 The decision of the Promoter regarding any aspect of the Prize Draw shall be final and binding and no correspondence or discussion will be entered into, in this regard.

5.2 The Promoter will contact the winner via a private Facebook message as soon as reasonably practicable after the Announcement Date as provided in clause 5.5.

5.3 The Promoter will not amend any contact information and the Promoter shall not responsible if a winner does not receive notification or delivery of their Prize as a result of having provided incorrect/incomplete contact details when requested following notification from the Promoter.

5.4 The Promoter may either publish or make available information that indicates that a valid Prize Draw took place. To comply with this obligation the Promoter may publish the surname and county of the Prize winners and, if applicable, their winning Entries in the Facebook post on 10/02/2025 (Announcement Date).

5.5 How to claim the Prize

5.5.1. The winner(s) will be notified via Facebook message as soon as reasonably practicable and once notified, a winner must provide a postal address with the information in (clause 5.5.6), to claim the Prize. The winners will be sent their Prize in the post.

5.5.2 If you win the Prize, you will have 7 days from the Announcement Date to claim the Prize as provided in this clause. If you do not claim the Prize by this date, your Prize will become invalid. You must provide a postal address to claim the Prize.

5.5.3 The Promoter will make all reasonable efforts to contact the winner s via private Facebook message. If a winner cannot be contacted or is not available, or has not claimed their Prize within 7 (i.e. by 10/02/2025) days of the Announcement Date, the Prize will be forfeited by that winner and the Promoter reserves the right to offer the Prize to the next eligible Participant selected from the correct Entries that were received before the Closing Date.

5.5.4 The Promoter shall not accept any responsibility if you are not able to claim the Prize.

5.5.5 The Prize cannot be claimed by an agent on your behalf.

5.5.6 Prizes will be sent to each winner with first class tracked postage.

5.5.7 If you do not want your surname and county included on the list of winners referred to above, you must notify the promoter a reasonable period of time before the closing date of the Prize Draw.

6. Limitation of liability

6.1 Insofar as is permitted by law, the Promoter (including its employees, Agent, consultants or sub-contractors), will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize or participating in the Prize Draw except where it is caused by the negligence of the Promoter.

6.2 Subject to clause 6.1, the aggregate liability of the Promoter (including its employees, Agent, consultants or sub-contractors), howsoever it arises in these Terms, shall be limited to the Prize (and where the Prize is not available, its money equivalent) and nothing more.

6.3 The Promoter accepts no responsibility for Entries not successfully completed due to a technical fault, technical malfunction, computer hardware or software failure, satellite, network, any system failures, network errors, website unavailability, hacks on the system, personal computer issues or any other issue out of our reasonable control or server failure of any kind. If for any reason a technical interruption, fault or site failure or any failure whatsoever occurs when submitting an Entry, the Promoter shall not take any responsibility for incomplete submission and any incomplete submission of an Entry shall not be considered as valid Entry, for the Prize Draw.

7. Ownership of Prize Draw Entries and intellectual property rights

7.1 All Prize Draw Entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned at the end of the Prize Draw.

7.2 By submitting your Prize Draw Entry and any accompanying material, you agree to:

(a) assign absolutely to the Promoter all your intellectual property rights held in the Prize Draw Entry with full title guarantee; and

(b) waive absolutely all moral rights in and to your Prize Draw Entry and otherwise arising in connection with your Entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

7.3 You agree that the Promoter may, in their sole discretion, make your Entry available on its website and in any other media, whether now known or invented in the future, and in connection with any publicity of the Prize Draw. You grant the Promoter a non-exclusive, worldwide, irrevocable licence in perpetuity, for the full period of the intellectual property rights in the Entry (and any accompanying materials), to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the intellectual property rights in the Entry (and any accompanying materials) for such purposes.

8. Data protection and publicity

We will hold your details securely and confidentially in accordance with the UK GDPR and applicable data protection laws. The Promoter will use your details for Prize Draw activities and marketing purposes on its website and social media platforms. We will delete them when no longer required.

You can ask us for a copy of your details at any time. Please let us know if your details change or if you no longer want us to hold your details.

9. General

9.1 Except as specifically set out in these Terms and to the maximum extent permitted by law, all conditions, warranties and representations express or implied by law are hereby excluded.

9.2 By sending your Entry, you are deemed to have read, understood and agreed to be bound by these Terms upon Entry into the Prize Draw. The Promoter reserves the right to refuse an Entry or refuse to award the Prize to anyone in breach of these Terms.

9.3 The Promoter reserves the right to discount any inappropriate or offensive Entries and to disqualify, from the Prize Draw. any entrant suspected of fraud or cheating including, without limitation, through the manipulation of codes, multiple computer-generated Entries, or otherwise in our opinion fraudulently falsifying data or acting fraudulently or dishonestly.

9.4 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Prize Draw.

9.5 The Promoter reserves the right to hold void, suspend, cancel, or amend the Prize Draw where it becomes necessary to do so.

9.6 These Terms are agreed between you and the Promoter. Apart from you and the Promoter, nobody else can enforce any of these Terms.

9.7 These Terms are governed by English law. If any Participant to this Prize Draw wish to take court proceedings, then that Participant must do this within the courts in the United Kingdom. The Participant agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim in relation to the Prize Draw.

10. By entering this Prize Draw, you acknowledge that it is not sponsored, endorsed, administered by, or associated with Facebook, Twitter, Instagram, or any other social media platform. You also agree to comply with the terms of service of the relevant platform when participating in our Prize Draw on social media. Additionally, you agree to release these platforms from any liability arising from or related to your participation in the Prize Draw.
